Terms & Conditions for Temple Point Resort Ltd. (2025)
I. Application 1. These terms apply to contracts for hotel room rentals and function room bookings, as well as all associated services.

II. Conclusion and Content of the Contract
1. Our offers are always non-binding. A contract is formed upon our acceptance.
2. We are obliged to provide the agreed services in our standard quality.
3. Unless otherwise agreed, check-in starts from 2pm, and check-out is required by 11am on the departure date. Post-checkout charges may apply for late departure.

III. Prices, Payments
1. The customer must pay the agreed prices for accommodation, functions, and other services used (including expenses we incur for third parties).
2. Prices include the current statutory VAT unless stated otherwise.
3. Invoices are usually issued in Euros. Payment in foreign currency may include exchange fees.
4. Invoices must be paid within 14 days of receipt. Late payments may incur 5% annual interest.
5. We may request a reasonable advance payment. The balance is due 14 days before arrival.
6. Any billing complaints must be raised promptly.

IV. The Hotel’s Right to Withdraw
1. If an advance payment is not made after a grace period, we may withdraw from the contract.
2. We may also withdraw if force majeure or other unforeseen circumstances prevent us from fulfilling the contract, or if the booking was made under misleading information.
3. We will notify the customer promptly if we exercise our right to withdraw.
4. If we withdraw, the customer is not entitled to damages.

V. Cancellation by the Customer
1. Cancellations must be in writing.
2. The following charges apply for cancellations of accommodation:
• Up to 31 days before arrival: No charge
• 30 to 14 days before arrival: 20% of booked room nights
• 14 to 2 days before arrival: 50% of booked room nights
• Within 48 hours of arrival: 80% of booked room nights
3. If a customer’s arrival is impossible due to extraordinary circumstances (like severe weather or flooding), we will not charge for those lost days, as long as arrival takes place within three days when possible.

VI. Provision of Alternative Accommodation
1. We may provide similar or higher standard alternative accommodation if necessary (e.g., overbooking, unusable rooms, etc.).
2. Any additional costs will be borne by us.

VII. Liability of the Hotel
1. We exclude liability for damages unless caused by our intent or gross negligence (or that of our representatives). In cases of mere negligence, we’re only liable for typical foreseeable losses. Liability for death or personal injury remains unaffected.
2. For guest accommodation, our liability for items brought into the hotel is capped as per statutory provisions.
3. We are liable for damage to vehicles only if caused by our staff’s negligence. We are not liable for damage caused by third parties.

VIII. Liability of the Customer
1. The customer is liable for damage to the hotel property caused by themselves, their visitors, guests, or agents. We recommend obtaining sufficient insurance.

IX. Final Provisions
1. Any amendments or additions must be made in writing.
2. If one term is invalid, the rest remain in effect.
3. Statutory provisions apply in all other respects.
